Short Course Description
Tort lawsuits are a frequent occurrence in the American legal arena. Courts often ordered the parties to mediation which includes statutory mediation of some matters prior to trial. Often court systems, in an effort to eliminate some trials, impose mandatory mediation as part of the litigation process.
Civil cases mediators can expect to spend a substantial amount of their time serving parties who are bringing or defending tort lawsuits. In this presentation, we will describe the basis of tort law, defines tort, and introduces three basic categories of torts, intentional torts, negligence, and cyber torts, and strict liability. We will close with a discussion on product liability theories and their defenses and consumer law.
Focus point:
- Torts are wrongful actions.
- Through tort law, society seeks to compensate those who have suffered injuries as a result of the wrongful conduct of others.
- Product liability is a major area of tort law under which sellers can be held liable for defective products.
- A growing body of law is designed to protect the health and safety and the credit of consumers
